I got a huge e-mail today from bustosfaxsettlement.vertismail.com with a lot of legalease in it, regarding a class action suit.

Anyone else get this? My radar must be off or broken, because I haven't heard a thing about this.

Just got it. I completed the claim form.

First I've heard of it. Up to $1,750,000 in settlement claims for Vonage, another hit at the bottom line.

In May, 2006, Plaintiffs brought suit against Vonage, alleging that Vonage made false and misleading statements and concealed material information in the marketing, advertising, and sale of Vonage Fax Service by purportedly failing to inform consumers that the protocol Defendant used for the Vonage Fax Service was unreliable, and, according to Plaintiffs, was unsuitable for facsimile communications.

I am NOT a Vonage fan, but, gosh, there are some VoIP companies (and other companies) that seem MUCH more deserving of a lawsuit!

Check the faq part out on their website, the maximum settlement is $19.98 per fax line. If every single eligible person files under the class action, the settlement is reduced to $4.17.

I received the same email but wanted to verify its validity before doing anything because couple aspects of this seem suspicious..

1. My understanding was that any sort of legal claim notices must be sent in hardcopy to the mailing address on the account, and electronic copies sent via email, as in this case, are not legitimate.
2. Didn't Vonage go public a few years ago? If so, any legal disputes the company is in the midst of must be reported to its shareholders and should thus be available online. I've been searching online for more info pertaining to the class action lawsuit, but there's nothing online other than the website listed in the email and other forums such as these with people questioning its validity like us.

So all that said, I'm no expert on lawsuits or any of these matters, but I'm choosing to ignore this email as spam.

The Ohio State Attorney General has it listed as a real case (11/2008).

It appears to be legit. I just received my notice as well. Goggle provided no useful information until you restricted it to messages from the last week under advanced search. The message I received was to our old contact point for them. I almost never get spam on it.

I probably wont bother, the research I'll need to do will cost more the $20 recovered.

But the problem with these suits, most of the plaintiffs (customers!) have no idea the suit exists, and most that do don't file the claim forms. So the money leftover goes to lawyers and such.

Class action suits are still supposedly useful to try to discourage bad corporate behavior in advance.

How much do the slimy lawyers get? A lot more than $19.98 or $4.17. What a crock!

Got a postcard in the mail from the claims administrator. Definitely seals it as being very real.

In 2006, the class action counsel was sanctioned:

A federal judge in the Western District of Washington has sanctioned an attorney and his law firm for sending dozens of "fill-in-the-blank" demand letters and filing cookie-cutter patent infringement complaints on behalf of client Eon-Net, a patent holding company based in the British Virgin Islands.

U.S. District Judge Marsha Pechman ordered New Jersey attorney Jean-Marc Zimmerman and his firm, Zimmerman, Levi & Korsinsky in Westfield, N.J., to pay the legal fees Flagstar Bancorp incurred defending against a patent suit filed by Eon-Net.

I received the same email as well as a postcard with the same info.
I am a costumer of Vonage and did in fact experience problems with the fax line I got through Vonage. I paid for about 9 months of service and I was very dissapointed to say the least. I will sure join the class action.
