With a torrent file, no one hosts the content, so they go after the users who actually download the file.
Also, copyright infringement has to be willful. I had no idea that Mickey Mouse image was there and I could easily prove in a court of law that I never intended to download it. Yes, you are not intentionally doing it but you are. And you definitely are if you watch the videos.
If Justin fails to remove the image, then yes, DSLr is hosting pirated content.
My point: Copyrighted content is everywhere on the net, it's in your IM's, your email, your favorite forum/blog etc.

You say im a thief if i download the DVD screener of the new Batman but you have no problem if i download a Mickey Mouse png file.
