Why even have a cap if it's less than 1% that even uses to much bw just deal with them

One only needs to look to the Flordia AG vs Comcast case to see why. It was ruled that you can't just deal with the 1% using too much unless you actually define a quantity that constitutes "too much."

Here's a hint: if you're exceeding that quantity, you're part of the 1%.
