On top of that since you have 4 or 8 channels assigned to you (and hopefully they mix the channels assigned to the users on a Node) the modem will prefer the non-congested channels that it is assigned so that congestion is less of an issue and thus the need to cap is reduced.

Also, the speeds tiers are ridiculous. D3 can do 160 (4 Channel) or 320 (8 Channel) yet they are not even offering speeds like Cablevision's (Optonline) BOOST DOCSIS2 30Mbs (really 38Mbs uncapped) let alone what D3 can actually deliver.
