It's going forward by certain affected parties who want to serve notice to ISPs that this profit line will not be tolerated. Suing Adzilla doesn't burn the fingers of the ISPs, but suing the ISPs directly makes them understand that consumer and legal backlash is significant enough that they should stay away from DPI of their customer's sessions.

Sure, the lawyers make money, but the plaintiffs underscore their point.
