One guy intentionally runs a dog fighting racket where dogs are dying a violent death because of it. The other guy unintentionally does something that results in someone dying. Yes there is a difference. |

Vick's crime had some forethought, planning, and malice. I think Stallworth should have gotten what the rest of us would have. |

Stallworths lawyer, David Cornwell, declined to confirm the existence of the video.
The contents of the video apparently had a significant impact on the ultimate plea deal. Though the 30-day prison term and two years of house arrest light have triggered significant criticism, the ultimate question for a jury would have been whether the evidence proves beyond a reasonable doubt that Stallworth caused or contributed to the death of Mario Reyes. At a minimum, the contents of the tape, as they have been described to us, indicate that a reasonable jury could have found reasonable doubt.
Whether the video results in a reduced suspension from the NFL remains to be seen.

But we will never know unless it's adjudicated. Other than the site linked, and a few sites that refer back to that site, I didn't find any other MSM corroborating source (admittedly I didn't look very hard). I would imagine this video (or the mention) would make the major news networks considering the gravity of the story. Almost sounds as if the local DA is in CYA mode.
Nonetheless, "if" it's real and "if" it clearly shows the victim literally jumped out in front of Stallworth's Bentley, the facts remain that Stallworth was driving DUI and at least 10MPH over the speed limit.

For the life of me I can't figure out any other reason for such a light sentence other than the genuine possibility of an acquittal if it went to trial.
I'm sure if there's a video it will leak out. And I do agree with sonofjay that anger at the light sentence is probably why the (supposed) existence of the video is coming out now. |

It was a horrific thing, as I wrote months ago, that happened to Mario Reyes, the 59-year-old laborer Stallworth struck with his black Bentley while driving drunk in the wee hours of March 14. Stallworth didn't own up to it immediately but, unlike Vick, didn't attempt to mislead investigators. He pled guilty and reached a confidential financial settlement with Reyes' family that led to his apparently light sentence for an error in judgment that will haunt him the rest of his life.
Levay pointed out to me that any prosecutor worth his salt queries the victim or victims for their opinion about the case in which they find themselves.
The Associated Press reported that Miami-Dade State Attorney Katherine Fernandez Rundle cited Stallworth's lack of a previous criminal record, cooperation and willingness to accept responsibility as factors in the plea deal that followed the financial statement and resulted in a month-long sentence. The AP reported that Rundle said the Reyes family -- particularly the victim's 15-year-old daughter -- wanted the case resolved to avoid any more pain.
"For all of these reasons, a just resolution of this case has been reached," Rundle told the AP.
Levay told me that part of Stallworth's restitution in this case can be seen in the terms of the settlement, whatever they may be. After all, many South Florida media outlets described Reyes as the breadwinner for his family.
It was also reported that Reyes may not have been in a crosswalk when Stallworth struck him. That is known in the law as "contributing negligence," and in some states, like Virginia, Levay told me, such a finding voids a financial settlement. That won't be the case for Reyes' family.
"The state can consider these circumstances," Dallas Criminal Court Judge John Creuzot reminded me Thursday. "It's not surprising at all in this deal. When you're in a situation where someone can make financial compensation...that can be part of the equation."

This professor, an internationally renowned expert on autism who pioneered several widely used treatments, and his wife were taking a nice afternoon drive a couple of towns over from me and a alleged drunk driver in his 60's with passengers crossed over into their lane and hit them head on.

Actually, the Vick case is worse than that. The federal charges were all based on racketeering, and had nothing to do with any dogs. The three year suspended sentence from Virginia was for the animal cruelty a(etc.) charges. I still say his NFL days are over. He lied to Goodell. As soon as I saw the Stallworth sentence, I knew someone cut a deal for money. Sometimes you can buy your way out. |

Im pretty sure that in about any state it was a slam dunk case for the prosecution. he was drunk and therefor illegally on the road. the guy could have throw himself under the wheels and stallworth would have been guilty. a pedestrian always has the ROW over a person that isnt legally allowed to be behind the wheel on a public road. just goes to show how sad our legal system has gotten. |

Stallworth suspended for 2009 Cleveland Browns wide receiver Donte' Stallworth has been suspended without pay for the 2009 season for violating the NFL's personal conduct policy and its substance abuse policy, the league said Thursday.
Stallworth, 28, who pleaded guilty to DUI manslaughter in Florida in connection with a March 14 crash in which he struck and killed construction worker Mario Reyes, will be reinstated after the Super Bowl in February 2010, the league said.
In a letter to Stallworth made public Thursday, commissioner Roger Goodel said, "I believe that further consequences are necessary" in addition to the punishment handed down by the legal system.
"There is no question that your actions had tragic consequences to an innocent man and his family, and that you have violated both the Substances of Abuse and Personal Conduct Policies," Goodell said. "In that respect, you are clearly guilty of conduct detrimental to the integrity of and public confidence in the NFL."
"Your conduct endangered yourself and others, leading to the death of an innocent man. The NFL and NFL players must live with the stain that you have placed on their reputations," Goodell said.
Goodell suspended Stallworth indefinitely on June 18, two days after Stallworth pleaded guilty.
After Stallworth spent the night drinking at a bar in Miami Beach's Fountainebleau hotel, police said he hit Reyes, a construction crane operator who was rushing to catch a bus after finishing his shift at about 7:15 a.m.
Stallworth told police he flashed his lights in an attempt to warn Reyes, who was not in a crosswalk when he was struck.
Stallworth had a blood-alcohol level of .126 after the crash, well above Florida's .08 limit. Stallworth stopped after the crash and immediately told officers he had hit Reyes. Police estimated Stallworth was driving about 50 mph in a 40 mph zone.
Stallworth was given a 30-day jail sentence and reached an undisclosed financial settlement with Reyes' family. Besides jail time, Stallworth's sentence included two years of house arrest, eight years of probation and other restrictions.
Stallworth, who met with Goodell earlier this month, said afterwards he would live with whatever punishment Goodell handed down.
In a statement he issued on Aug. 6, a day after meeting with Goodell, Stallworth had said "I recognize that there is a difference between the legal standard in my criminal case and the standard to which NFL players are held.
"It is clear that I exercised poor judgment and caused irreparable harm to Mario Reyes, his family, the NFL, its owners, coaches, employees and to my fellow players."

| reply to Moorecards Stallworth completely agrees with the punishment and seems sincere in his ownership of his mistake. And he is not taking the path of filing a labor grievance against the league or suing the NFL. All of this will likely make it better for him to get back in the league and earn a spot as respected player again. He should take this year and spend it on learning how to warm up and stretching experiences and find a way to cut down on those hamstring injuries  -- Mission Accomplished |

| I agree. He's been responsible since the moment the accident happened. If he spends a year doing what's required of him, and doing what he can do to remain in shape he should apply for reinstatement by the league. If the league agrees he should apply to have the terms of his house arrest modified to allow him to interview, try out, practice, or play as the opportunity presents itself.
Of course, then he'll injure his hamstring again. -- this is serious |
