Why did he need to download Wall-e in Mexico? Shouldn't this person be, I dunno, on vacation? The person that did this was a complete idiot and I shed not a single tear for him or her.

Still, there is responsibility on both sides. In this case, the provider disclosed the rates. The consumer, however, clearly didn't. If you're going to travel internationally and you don't take time to find out what costs are to do so, either pay the price for your stupidity and "ignorance" or simply turn your phone off.

When one travels, you're supposed to check on many things.. insurance for driving, what to do if you're hurt (ie: health insurance coverage) exchange rates, laws, etc. ANYONE with half a brain would simply pick up the phone, call their provider and ask "I'm going to travel to Mexico to get Swine Flu, most likely use my data card. How much are you going to charge me to download movies all day?"

Simple.

He needs to pay the $17,000. I believe they are being gracious. If this guy doesn't pay the bill, then why should I pay ANY overages here in the states? Rates are disclosed.. read them.

I think they are saying that Telmex (or whoever it was) charged that much to the US carrier. The $17k was the passthrough charge for international roaming.

I never said it was the true cost to Telmex, as they arent the company billing the end user. I pointed out that since the customer was billed roughly $65k, it makes sense that the wholesale cost to the US carrier is around $17k (add a nice 400% markup and voila! ). For this reason, its not up to the US carrier to determine whats a fair rate, as they themselves received a bill from a 3rd party.

Keep in mind this isnt the same thing as someone getting a high bill within the US. In that case the carrier would obviously have much lower actual cost to deliver the service.

Do we even know that $17k is the wholesale rate? For all we know is that the wholesale rate was $30k and Telmex or who ever reduced their rate.

We have no idea. I was just assuming that the US carrier agreed to knock off all their markup as a show of good faith. If they (US carrier) then decided to further eat the cost

Hey, a free market is a great idea....oh wait...did someone say "industry standard price"? Hey, how come prices for broadband keeps going up? If it is truly a free market how come I can't choose a different ISP? I remember back in the day when a text message was TEN FREAKING CENTS, now it is 30 cents for 160 characters. Do the math. Free market? I think a free market only works when there are multiple NON GREEDY companies competiting for a good service.

Gouging a customer is one thing, having your rates published for a service you subscribe to, and didn't pay attention to, is another.

The customer was informed of rates, however, he decided to download a movie. He got billed what they disclosed he would. Who's fault is that?

The ignorant idiot got his bill wiped out, which to me, as someone that has seen overages, is a slap in the face to.

What this tells me is that if you go over your cap by a little, you get billed. If you go over by a lot, they'll just wipe it clean becuase the bill was too much.

I call BS.

I don't care what it costs them to provide it. I also stated that 17K was high, and suggested something more of $1,000 would be reasonable. It may hurt and take him a while to pay it down, but the bottom line is he consumed, he did so WAY over his cap, there is a cost to cover this, and they are certainly allowed to make a profit.

The subscriber was an ignorant user that, like many, didn't read his rates disclosure.

That's a very narrow view you've got there. Honestly, you shouldn't pay overage charges when they reach that level. I would not look down on you for completely skipping out on even a $1,000 overage charge.

If punching you in the face and taking your money was legal, and I did it... would you say that it's alright and I had the right to hit you and take your stuff? I don't think so. Most likely there would either be direct action by you or more probable: You would go find someone to do it for you.

Fooling a customer with psychology (ie putting the charges in tiny text hidden deep in the contracts) is never right and should never be tolerated under any circumstances.

I hope that gentleman does NOT pay this charge just as I refuse to pay any form of idiotic bills, charges, fees, and other such nonsense.

This also goes with the fact that I'd be willing to fight someone to the death if they had a grudge against me. Are you willing to take responsibility for your own life and get rid of all police? When you are, you can come back and tell me that man has to pay the bill. Until then, you're another pansy hiding behind someone else/your computer.

You've made many assumptions and nothing factual.

That very government that everyone looks to for help has established how a company must disclose rates. They disclose the rates.. you are given paperwork, you are responsible to read it. END OF DISCUSSION with me on this one. I am not a college major and yet I still read what I'm agreeing to. If you don't want to, then YOU live with the consequences.

You have proven NOTHING that anyone is being fooled, other than the customer is being foolish!

What I can't believe is you sit here and call me narrow. I don't care what you look down on me for or not. You and so many others are sitting here making excuses for someone who may have rightfully so made a mistake, but I think he needs to pay A price.

You and your crowd are the same ones that are running around CRYING that AIG, and banks across the country got bailouts. These banks did greed and stupid things, yet they're being bailed out. Um, this is the same thing.... The data provider had to bail out the idiot customer.

It's time people start being responsible for their actions.

And for the record, I WOULD look down on you for walking out on a bill of even $1,000. Go into a restaurant with a crowd of 8. You have only so much money and are on a budget. You didn't see the small print that 15% gratuity is added to all parties of 8 or more. The bill comes, you saw ALL the prices on the menu for what you ordered, but the added 15% puts you over your budget.. you run out? You say "I didn't know"...? do you say "That was in small print (which it is) and I didn't see that.. you buried it!!" Or, do you figure out how to pay the 15% gratuity that YOU OWE?

I don't make excuses for people. The 17K was a bit excessive IF charged by the domestic provider. BUT, it angers me that they would write off ANY direct billed cost they incurred by the Mexican provider. If anything, I would have liked to see their account canceled. I'd like to see the amount go to collections, and wind up on their credit.

This was a clear reward for ignorance.

By the way: He does pay. It's called a monthly bill of reasonable amount. $17,000 is no realistic cost of anything, and I dare you to prove that it is. Go on. I'm waiting.
