I think its going to be a grey area.

Wireless - so far, has been able to successfully ban many apps through their ToS.

I don't see people running BitTorrent over 3G, VoIP applications have been banned, even if they actually work.
Unlike landlines, there is a limit of capacity, and there is competition.

There's a few options:

1. Find a better carrier
2. Deal with it
3. Have companies like AT&T remove their walled garden approach (which will only lead to caps on handhelds)

If Sling created/allowed the App for the iPhone, then they know its going to be used on WiFi only.

AT&T can claim the fastest 3G network as you are pretty much banned from doing anything on it!
