That's true, maybe against music and movie thieves, none which really applies to the Pirate Bay anymore than it applies to Google or MSN. When the Pirate Bay starts offering up the actual files that are the music/movie in question, then yeah, they will be roasted. Otherwise, you might as well make the same argument about Google, Yahoo, MSN, Ask, and any other search engine that has an index of torrent files like the Pirate Bay.

They do in the cache, a torrent file is nothing more than text with trackers and the hash, so yeah, in a technical sense, they do host it. Point is still valid.
I figured I would throw this out,
Here is the data clip within the "Underworld Rise of the Lycans" torrent currently on the Pirate Bay, then followed by the Google cache (open it with a hex editor or something).
Yup, Google has the same thing, so technically, they are both Pirates?
Here is what google has in their cache:

The function of a Centralized Tracker in a DHT system is to provide a list of the peers who currently are trading the file. Once you have this information, you can contact them to get updates on who is currently peering. Without that Centralize Tracker to prime the cache of peers, you must rely on the list in the torrent file you started with and depending on its age the listed IPNs may be stale and no longer seeding. Getting the torrent file from the tracker insures it is up-to-date and the provided IPNs are there to talk to you. |

Plus if the Piratebay tracker didn't exist in the first place that file wouldn't have been in DHT in the first place.
Comparing Google and Piratebay is a weak argument as one has the obvious purpose of indexing torrent files and providing a tracker to pirate while one caches the whole internet basically and just has some pointers to torrent files.
FYI: I use Piratebay and Usenet actively. |

Google "[Some Movie] Torrent" you find tons of links to said torrent from across a multitude of sites. And if google is infact caching the torrent files themselves, then they're doing the exact same thing as TPB, they're just going a step further and doing it for all the sites they've crawled. |
