Verizon, in addition to cheering that decision on its own (since they're fighting that battle in places like NYC) used the ruling in that case for this issue as well, telling the FCC 'you have the authority, per that other court decision, to do this...']]></description>

<description><![CDATA[Greg2600 posted : Sounds like, to answer billy2's question, Verizon did not file this complaint with the FCC until there was a prevalent court decision. I noticed one post (think it was by billy2) about switching to TWC.  Throughout the petition they seemed to use studies showing how these exclusive carry agreements affected DBS penetration rates in some markets (e.g. here in the Philly area the fact that DBS penetration is 40% below what would be anticipated due to CSN Philly - it is pretty striking how light the DBS penetration is in some areas around here).<br><br>The fact that CV gave rights to SOME companies (e.g. TWC) while not to others is the point, I think, they were trying to make - that CV (and not just them, but other cable providers) were using those exclusive carry agreements in an unfair way - trying to affect the ability of SOME providers to compete.  It's really striking that, even in areas that CV doesn't service, they won't let Verizon carry MSG HD, but they'll allow TWC to carry it in those areas.<br><br>I'm sure there are DBS customers out there that will be following this too - if the FCC acts in the way that Verizon is petitioning them, then I believe that would effectively mean the end of the terrestrial loophole.]]></description>

Never mind that we could never get Cablevision here. Of course Cablevision has no problem letting their "Cable Buddies" Time Warner carry the HD feed of MSG. I only pray that this gets done before the hockey season starts. I don't think I can stomach another year of SD Sabres games.]]></description>

<description><![CDATA[robjlevin posted : I still think they should have taken them on.<br><br>In the '50s the movie studios were forced to sell the theaters they owned to increase competition...in the '70s ATT was forced to break up the company to increase competition.<br><br>What the Dolans are doing here is virtually the same thing. Controlling the entire channel (no pun intended)...teams, building, programming, distribution.<br><br>Better late than never, at least for those who've stuck it out. Like I said, it's not going to affect me, one way or the other.]]></description>

"Without access to high speed fiber, many customers simply will not consider a competing provider's services."<hr></blockquote><br><br>Kinda funny how when you change a few words around, it still makes sense to the lay person, but from a business sense, Verizon is totally oppose to it.  Why should Verizon have to help the competition?  If it's really about the customer choice as they claim against MSG...they would do it.<br><br>Also, has the FCC terrestrial loophole changed recently?  At one time RSN had to make their programming available to the competition if the signals were transmitted via satellite.  If they were transmitted by fiber or a dedicated link, and not OTA, they did not have to be shared with others. Comcast SportsNet Philly <A HREF="http://www.fcc.gov/Bureaus/Cable/Orders/1998/da982151.txt">successfully used this to block DirecTV</a> from carrying the channel in the late 90s.<br><br>Also, is there any specific law or ruling that states that HD programming must also be shared if the SD is provided?]]></description>
