 Who is abusing who?

Having been employed by a company that provided both Dial-Up Internet Access and Web Hosting, I participated in numerous meetings where Network Operations described the constant battle the abuse department had with customers that violated the Companies Terms of Service. It takes time to notify a customer of the violation and give them time to correct same before taking their website offline. This was particularly important where a websites server was hijacked by malware.

The real abuse might be by the FTC against the Web Hosting Company. If the FTC took down 15,000 websites because a handful of the hosted websites were in violation of the law there might need to be more judicial oversight before such action is taken in the future. 3FN might have been guilty of nothing more than having an inept abuse department that was not monitoring and acting on complaints received regarding hosted websites.

Well, of course it is... because they say so, and the accusation of wrong-doing is all the proof that anyone needs--if one is a Nazi or a Cuomo or something.

I also work in the ISP industry and before you decide based on what your read that the whole ISP is at fault be careful as the media often only tells part of the story. We had an issue months back where one of our IPs was used in an attack, as a result another ISP decided to block our entire range of IPs keeping customers from getting to our hosted sites. This was an overzealous measure that cost us time and money. One bad apple doesn't spoil the entire lot. The FBI and FTC love to get press on these type of problems as it makes it seem as though they are on the forefront of technology issues - the problem is (and I think this analogy says it best) it would be like bombing the entire middle east to solve problems with terrorism - you end up killing more innocent people than the terrorists themselves and the end terrorism finds a new place to hide. Just like blocking all newsgroups because 1% of the data contained therein proved illegal....smoke and mirrors designed to satisfy the appetite for justice.

The reality is that before providers get cut off, months, if not years, of complaints and emails and letters go unanswered or ignored. Providers get cut off only after attempts to work with them have failed.

Now, from the Washington Post article, it appears that 3FN was a known source of malware since October of 2008. In that time, again based on the article, it was never corrected. In light of that, these guys probably would have been disconnected by their upstreams eventually if the FTC hadn't done it.

While that is a valid argument in most cases, I can tell you for a fact, that 3FN / Pricewert LLC / APS Telecom was notorious for being a willing facilitator for global organized crime. They openly solicited that business and charged a premium for it. They are part of a group of companies that due to lax registration procedures, are able to masquerade as being US entities, in order to avail themselves of US bandwidth, peering, and access to the US banking system. A la McColo, other than their servers being located in the US, the company itself is owned and ran from Russia and the Ukraine. Their business model was one of providing service to and participating in all facets of organized global cybercrime.

This was not your mom's ISP by any means. The only surprise to those of us that monitor and track this activity, is why it was allowed to go on for so long, unabated. This action will not close them down, only move them back out of US cyberspace.
