| South Carolina Car Repo Laws. Help!
Well this is what happened. I was making my payments and all and everything was fine but I ended up going to Baltimore. I was set up to pay 120 $ a week to the car lot where I got the truck from. But when I went to Baltimore I ended passing out in my room and I almost died my parents found me unconscious and laying in my bed struggling to breath. They called 911 and got me in the hospital where I was in a coma for week and then I was in the hospital for another they said I had a bad infection in my brain and they also preformed a spinal tap on me because they originally did not know what was wrong with me and I think they may have damaged my back.
When I woke up i could not feel my right foot and it was later explained to me as the condition of foot drop from nerve damage in my spine. The doctor said because I was out of it the people might have on a mistake damaged my back because I did not respond to pain. So now I can Hardly walk and I have severe nerve pain in my foot that feels like its burning and electric is shooting threw my foot.
As this was going on the dealer has been calling my house and trying to get a hold of me, they got a hold of my mother and told her that I could give up the truck or they would have me arrested and a warrant put on me and would have me locked up and sent back down to south Carolina and thrown in jail.
So we did give them the address & I told the lady what happened to me and that I would pay her soon as my unemployment checks would come in (1 week) and that I was not trying to run with the car that I was simply visiting but ended up having a medical emergency. She said she would try to work with but she wants the full payment that I owe of 800$ and nothing less. I told her I could do 400 but I can't pay 800 out my back side. But when i got the car I payed $4500 for my car as a down payment and I don't want to lose it. I owe like 3000 but with interests its $4,000. By the time they they get it back to south Carolina and do what ever they do I will owe even more then the truck is worth and they have the money I payed for it plus the truck to resell.
My question is, can she really have me locked up in Maryland and have me sent back down to south Carolina and sent to jail. Because I was told that this was a scare tactic to get my address and to get the truck back with out a fight. The reason I ask is because I am thinking about putting my truck in the garage and just not driving it like a friend told me to do and just send the 2 payments down and have the bill paid back up with out giving the choice of taking it from me since legally they can go in the garage to take the truck.
Also when I got the truck it had no oil in, the breaks where metal to metal and I had to replace them but in south Carolina the law is you buy as is. I also had to replace the blinker and a few other minor parts on it. So I have put money in to the truck and am not trying to have them take it from me just because I had a medical emergency that has left disabled.
Please give me your best opinion and may be even links that might help! I really do appreciate any help you guys can offer me! |
