Why should Apple and AT&T (using the public's airwaves) be able to legally put the screws to your freedoms and wallet? You can buy a computer and use it on any provider's Internet service, so why can't we do this with any phone that won't harm their network?
If we had wireless freedom of choice, iPhone would be dual-mode (it would work on Verizon, too) and the carriers wouldn't limit how bad-assed the iPhone could be by controlling the App Store.
