Update: Suit dismissed with prejudice

A federal judge has dismissed Roger Clemens' defamation suit against his former trainer, Brian McNamee, ending that chapter of the litigation in Texas and shifting the focus to New York, where McNamee has filed his own defamation suit against the former Cy Young Award winner. The New York Daily News first reported the dismissal, which took place Aug. 28.

Clemens' attorney, Rusty Hardin, filed the suit on Jan. 6, 2008, in Houston, claiming McNamee was "malicious and grossly negligent" in his remarks about Clemens to baseball investigator George Mitchell and SI.com.

Federal judge Keith Ellison of the U.S. District Court dismissed the case with prejudice, meaning Clemens cannot file the suit again. Clemens does, however, retain the right to appeal.

"Brian has defeated Clemens in Texas," McNamee's lawyer, Richard Emery of the Manhattan firm of Celli, Emery, Brinckerhoff & Abady, told the Daily News. "And now the battleground moves to New York."

Clemens is under investigation by a federal grand jury in Washington that is trying to determine whether he lied when he told a congressional committee in February 2008 that he had not used steroids.
Clemens has really screwed himself.

Judge reaffirms ruling in Roger Clemens' defamation case; paves way for Brian McNamee's own suit

The decision Tuesday by U.S. District Court Judge Keith Ellison reaffirming his original dismissal of most of the claims in a defamation suit paves the way for McNamee to advance his own defamation suit against Clemens, which McNamee's lawyers say they will file at the end of July.

McNamee owes his legal team hundreds of thousands of dollars for defending him from Clemens' defamation suit, as well as for helping him navigate a congressional investigation last winter.

“This is the final nail in Clemens' Texas coffin," said Richard Emery, McNamee's defamation attorney. “We will welcome him to New York to litigate. We'll file a complaint by the end of July on defamation and other claims by McNamee.”
So Clemens has basically lost his defamation suit, McNamee will now sue him for defamation, Clemens is being investigated for lying to Congress, and I believe Clemens is being investigated by the IRS.

I don't expect him to change tactics, spending tons of money going after people who've spilled the beans on him and lying with a straight face to every camera. But his tactics aren't working.
