I believe shaping, throttling, caps, etc., all have roles as valid network management tools if they're implemented correctly. "Inexcusable" is relative to who's managing a network and attempting to make a profit. Your sweeping statement about not hurting for cash ignores a big swath of smaller ISPs that may not have over abundant resources.
