Why is apple being sued. MMS works fine on my 3Gs. Apple's product works fine as advertised. ATT on the other hand is not allowing MMS to its customers. Im still not sure this warrants a lawsuit.
T-Mobile on the other hand lets me MMS all i want.

Exactly, Apple should not be sued here. They delivered a product that can do MMS, but AT&T failed to allow its customers to do MMS by a limit they imposed on customers accounts.

AT&T should be sued here because they totally failed, MMS should have been available when 3.0 came out. AT&T had plenty of notice that 3.0 was coming.

Because Apple advertised MMS during the iPhone 3.0 roll out... they added in VERY SMALL print on the bottom of the ad "MMS will be available in the US by the end of Summer".

This is an AT&T problem, but no one knows why they did not let this functionality work day 1. They first blamed it on AT&T account system and they needed to go in and change setting on it so MMS would work. Then later the news was AT&T was busy beefing up their network as the current one would not handle the expected volume of MMS messages. No one really knows. That is part of the problem.

I think the lawsuits are just a way to further expose AT&T's lack luster network and to continue to pressure Apple to break the exclusive contract and go to other carriers in the US.

You have to remember. MILLIONS OF IPHONES NATIONWIDE... millions. remember that number. Now, you also have to remember -- AT&T's network had to take the massive beating from the millions and millions of iphones.

It's not lackluster. I think they're doing quite well for having to deal with a media load that no other carrier has to deal with.

Well, I would agree with you... but the MILLIONS and MILLIONS of iPhone are paying AT&T a min of 100.00 per month for that service... So they should be upgrading their network like gang busters... but we find out, they are not. They are just taking the extra money and not investing back into the network.... When and if, Apple ever picks up more carriers in the US, people will leave AT&T in DROVES....

I don't know about everywhere else, but here(in the 100-150 miles surrounding DFW area in TX...) 3.5G is available, and is never congested.. It's always quick. I can't tell you the last time I've seen edge.

I assume they'er still doing it, just slowly

Oh, and I agree. I may leave AT&T if I ever decide to get an iPhone from a different carrier.. but for now, I'm fine with my AT&T ;D

Obviously AT&T is making insane profit margins off the iPhone.

A recent article here revealed how AT&T even blindsided Apple with their intensely greedy refusal to upgrade their networks.

About 80m AT&T subscribers. Less than 10% of the subscribers are iPhone users. You want us to believe less than 10% of users are bringing down the rest of the network?

You probably also want caps on bandwidth to those heavy users.

That's still millions. Also, I don't know about there, but here, ever since the iphone has been deployed, so have a vast amount of network upgrades. So yes, I do think that the iphone is bringing down quite a bit of the network.

and no, why would I want caps? You assume because I posted something, that I'm a cap lover? no thanks.
