And background downloader data isn't even available yet. The first big push usually comes out several weeks+ before the patch actually drops.
At the earliest (unless they deviate from how they currently do things, unlikey), we might see it in time for Christmas.

As stated before, they didn't release anything for the downloader yet, not even the art work. And may I add that Shaman tier 10 isn't even finished yet! It can't even be datamined because it doesn't exist.
I think this patch has a long way to go PTR wise.
edit 2: however, it would not surprise me if there was an early December release date, between Thanksgiving and Christmas. If it isn't released by the 17th, it won't be out till 2010.

They're supposed to give 2 weeks notice before an arena season ends. If they release the patch before the end of the season it will really screw up the season so I doubt that will happen. I voted Dec 15th but I wouldn't be surprised if it's 2010. |

The current arena season started September 1st. Season 5 was 17 weeks and season 8 was 18 weeks. It's been 9 weeks, so we're only about halfway through this season.
I vote 2010 as well.

My guess is based off past actions taken by Blizzard Entertainment in regard to patches.
Edit: I remember when the BC preparation patch, patch 2.0, came out during the first week of December 2006 and introduced the new honor system. Played non-stop steamroll AB with a premade all Christmas Break. Burning Crusade then released in January 2007.
Also -- didn't they push back 2.3 to December because they didn't want to deal with the maintenance a major content patch required during the Thanksgiving holidays? I seem to recall that being the excuse when people had been asking "Where's 2.3?! The background downloader started a month ago!"
