it's not so much about an ability to tether, but rather complying with their TOS/AUP

knowing verizon, they can be pretty big assholes.
if they'll see that your droid suddenly has a user-agent of FireFox, or there's a download of fla movies from youtube while there is no flash on android, it's obvious the phone have been tethered and then verizon can start charging you by KB or forcefully terminate your service for breaking TOS/AUP.

who says that the phone doesn't support flash. can you not mod your phone? or do they still own the phone?

The last I checked the Droid does support Flash as well as YouTube.

It will play YouTube videos on release but flash won't come out until early next year on the Droid but it IS coming.

It may support "Flash Lite" which is somewhere in-between Flash 6 and 7 in terms of functionality and compatibility. Almost completely useless these days since most sites require Flash 9+ Adobe has announced support for Flash 10 on mobile sometime late this year on select devices with more mainstream support later in 2011. I'm not convinced they're going to be able to pull it off. They announced Mobile Flash 7 years ago, delivered a couple of buggy slow releases, and gave up. Maybe things will be different this time?

you checked wrong.
"support youtube", ie downloading 3gp videos is not the same thing as going to the real www.youtube.com and downloading real .FLA movies.

none of the android phones support real flash yet.
