Yes, and then everyone will start to sue because someone who used 1GB a month got charged $40 and the the one who used 10GB got charged the same $40, yet the one that used 300GB got charged $150. This means the person with 1GB usage will sue because they deserved to only be charged $4/month, based on the usage.

See how much grief this would cause everyone.

You just defined metered billing. Metered billing is when everyone pays the same amount for the bandwidth they use. People who use more bandwidth pay proportionally more than those who don't turn on their computer that month, for example.
