nah they will just get sued if they did that

just like Sony Bricking 20/60GB so you have to pay a 150$ fee or BUY A NEW SYSTEM

they continue to make a lot of money off the 20/60GB

they have two classation lawsuits on that
one in the US and one in Canada

the Lawsuits is because the software update Bricked systems (YLOD),Bricked Blu-ray drives,cause legit games Not to work ,video output issues via hdmi,deleted game saves(SEE BRICKED SYSTEMS),back up software does not work (on my system anyhow ) Controllers STOPED WORKING etc...

firmware:3.0x (3.01 just bricked even more systems etc...)

Law Firm Contemplates Class Action Suit To Recompense Xbox Live Modders

A US-based law firm is gearing up to file a class-action lawsuit against Microsoft for banning around one million Xbox 360 users from its Xbox Live service over the charges that they have modified their game consoles.

Abingdon Law, a Texas-based law firm, has put up the outline of its probe while looking for banned Xbox Live users to have compensation.

In its allegations, the company says that the software giant intentionally plotted its recent barring order at this juncture against the owners of modified consoles, soon after the release of some of this year’s most-awaited games.

The firm’s website quoted: “An investigation is currently being conducted regarding business practices of Microsoft with respect to its recent cancellation of certain modified Xbox consoles for use with Xbox Live”.

It further goes on to say that the software maker deliberately “timed” the Xbox console banning order, which came soon after the release of the new ‘Call of Duty: Modern Warfare 2’ game, and around less than two months after the launch of the immensely popular “Halo 3: ODST game”.

The company refers to the barring of Xbox Live users a “weapon which has resulted in a great deal of collateral damage - many people were affected who had nothing to do with piracy”.

MS acted accordingly and made the right decision, nothing more than modders acting self-righteous again. Now if the modders were willing to undo the mods (if that's even possible) then MS should take those consoles off the ban list, the likelihood of either of those things happening is dismal.

On the Xbox forum, there you can appeal a ban. I forget the name of the MS employee, but she will review your ban upon request. I'm guessing she has the ability to review whatever Microsoft saw that caused them to ban the Xbox. I believe the consequence for requesting a review, if the ban is sustained, is loss of your Xbox live account.

Some have taken her up, some have not.

The argument on the linked article, seems to complain about the timing of the ban. Personally I think that is a non-issue. Microsoft can ban a hacker at any time. I think 8AM on 12/25 would be the best possible time to ban a million or so consoles, but that's just me.

I agree with you on the timing. Actually I think it's perfect. What a better time to nail them than when they are most excited to play online?
