I forget the name of the MS employee, but she will review your ban upon request. I'm guessing she has the ability to review whatever Microsoft saw that caused them to ban the Xbox. I believe the consequence for requesting a review, if the ban is sustained, is loss of your Xbox live account. Some have taken her up, some have not. The argument on the linked article, seems to complain about the timing of the ban. Personally I think that is a non-issue. Microsoft can ban a hacker at any time.
