They can either choose to not use a cell phone, or take out the battery when they are not using it.

Also there is a difference between the phone company knowing which tower(s) is serving your phone (this is needed for your phone to work) and your phone continuously sending your GPS coordinates in an unsolicited way (this is not needed for your phone to work). |

Of course there is, but that doesn't change the fact that if you do use your phone, the cell company is going to at the very least know the location of the tower you're on.
