AT&T is SELLING something they can't provide. AT&T made TONS of money selling the iphone, which they KNEW they couldn't support. The real evil criminal here is not the users, not the person calling for this, it's AT&T. If criminal charges ARE going to be filed, they should be filed against AT&T, for KNOWINGLY selling something they knew they couldn't support. AT&T should be jailed, but, since you CAN'T PUNISH a corporation with the same laws they apply to real people, the next best thing should be done, and AT&T's charter should be revoked, breaking up the company.
