How is making sure atts network stays up not looking out for the consumer? Their are people who dont care about datqa and want to make a call who would also be brought down by this.

Quite a few people seem to have it in their mind that high data usage on the network is going to affect voice calls. If it somehow does then the blame falls SQUARELY on AT&T's shoulders. It is not the end-user's fault for using a service that he or she pays for. |

The FTC could use this to charge AT&T with fraudulent sales, IF they believe they can prove AT&T KNEW* and deliberately oversold it's capacity (beyond the normal multiplier used to manage ALL non- dedicated networks)
*AT&t "KNOWING" is way beyond saying it's a no brainer, more is that they had calculated bandwidth usage, and KNEW that it would definitely be inadequate, but proceeded anyway. Very hard to prove unless damning e-mails or memos are found. |
