| What is illegal? is selling a modified piece of electronics illegal? is showing in a video how to modify a piece of electronics illegal? is owning a modified piece of electronics illegal?
or should it just be using a piece of modified electronics illegal?
shouldn't the sharing of information, such as modifying, protected under the 1st Amendment?
selling, instructing, and owning is not theft of service. nor should the FBI shove its 'dirty harry' nose in Big Business until an actual crime has been committed. -- I've come here to chew bubblegum and kick ass and i'm all outta bubblegum. |

| It's your duty as a citizen if you have information that a crime has been committed.
Don't forget both chambers of congress and the current white house occupants too.
(and you can have all the credit, don't mention my name....) |

 | reply to Harddrive said by Harddrive:is selling a modified piece of electronics illegal? look for the people who bought XBOX, modded them (either hw or sw), and get bricked. then, they try to get a replacement, and their request is denied.
said by Harddrive:is showing in a video how to modify a piece of electronics illegal? look at the cap'n crunch blue boxes of 1980. DMCA - even covers garage door openers.
said by Harddrive:is owning a modified piece of electronics illegal? Again - DMCA. Patriot Act. Look at what Apple did last winter - asking the users to stop jailbreaking their iPhones b/c a jailbroken iPhone could take out the entire cellular network (forget that it already does - that is their argument)
said by Harddrive:or should it just be using a piece of modified electronics illegal? DMCA. just give every right you thought u had away.
said by Harddrive:shouldn't the sharing of information, such as modifying, protected under the 1st Amendment? Ask DVD-Jon. he broke the CSS copy protection of the DVD in his country, published his results, came to the US, and was arrested for it. how many security researchers refuse to be identified after discovering a security hole. read about the guy who just found the major DNS expoit. he was afraid of going to jail the first few interviews he had.

by legal goals i mean things like ripping DVDs to an HTPC, not uploading them, keeping them strictly on LAN. -- [65 Arcanist]Filan(High Elf) Zone: Broadband Reports |

 | reply to Harddrive I don't think that the act of developing techniques to exploit security holes should be a crime.
I do think that selling devices designed specifically to steal service on a particular provider should be illegal.
The former is like selling key blanks and a machine to copy keys.
The latter is like someone selling keys to your house.
I'm sure we agree that the latter should be illegal. |

fiberguyMy views are my own.Premium join:2005-05-20 kudos:3 | reply to Harddrive Ummmmm... please read the constitution before you speak of the 1st Amendment.. you don't have 100% free and unabridged speech.. if you believe that, by all means, PLEASE go find your nearest movie theater and in the middle of the show yell "FIRE!!!" ... or, go to an airport terminal and start talking about bomb making.. please.. do that, and come back and tell us about the 1st again.
Selling a modified piece of electronics is illegal if the intent is to violate an underlying law.
Showing a video.. that's iffy, but I agree with you there, so long as any law isn't being violated.
OWNING a piece of modified electronics.. yea.. illegal... I assume that simply OWNING crack shouldn't be illegal either in your mind too?
But, you're wrong on your last statement.. yes, there are laws about owning, selling and instructing in certain cases.. sorry... but, that's the truth..
The 1st amendment argument is getting old.. in some people's minds, you have a 100% free and clear right to say ANYTHING you want.. when in fact, you don't. The 1st only protects your speech AGAINST and TO the government.. but, congress still has the right to pass certain laws which does cross with the 1st.. so yea.. remember.. go yell "FIRE" in a movie theater, would ya? let us know how that works for ya.. and don't forget to mention you're 1st rights too.. or, the next time you want to attend a protest with out a permit, just cite "the 1st" as you're being hauled away... |
