stealing is wrong
imagine someone owns a house, imagine that person leaving their door open, that does not give the right for someone to walk in and steal from them.
also, theives hurt the rest of the people who are honest and are paying. how the costs of the service is not being shared by theose stealing it.
i like my broadband internet, especially when im downloading the latest video game at lighting fast speeds, and i know it costs money to get me that level of service, so i just cant side with those who steal it.
think of a local store who sells shoes, shoes i like and buy, and some people well they rob the store, when i buy a pair of shoe from that store part of the price i have to pay is for the shoe and the other is for the theives. else the store goes out of business and i can no longer buy the shoes that i like from it.

Providing info / selling modified equipment shouldn't be a crime. Using it to steal service is.

Ummmm.. okay... if you say so...
Selling hacked key cards to a secured building that you have no right to do so should be okay as well.. it should be a crime only when someone uses that key, right?
The fact remains.. it's not this guys place to sell hacked hardware to circumvent the security features of the ISP.. What you and many are failing to realize is that this guy isn't just selling blank keys.. he's selling the ones already cut and able to open the door to the ISP... he's "hacked" - think about the word HACKED for a moment.. there are SPECIFIC LAWS on the books about hacking.. the guy did the hacking, which is illegal.. he hacked the system to make his modded modems work.. that's a crime. Owning and possessing something that is technically deemed illegal IS in fact a crime too..
Law is not cut and dry.. just becuase you find one area that is gray and "seems" okay.. or "should" be okay.. there ARE other laws that do support defining crime.. like the 1st.. people think we have free and clear freedom of speech.. we don't.. there are OTHER laws that do work WITH the 1st that do actually limit the speech and supporting actions that cause the crime..
So.. I assume that making and putting together dirty bombs and selling them shouldn't be a crime either.. just only when they are used.. right?

If I understand right, he found an exploit and is applying it to these modems. He didn't modify the cable network. So it is not 'hacking' as you put it.

The fact is that he modified a modem, which is not end-user accessible, or designed to be such (look up what a DOCSIS modem's design is please).. he then hooked up an unauthorized device to the network which granted him access to something he wasn't supposed to have... so that alone "hacks" into the system... The law speaks clearly to this matter.
You can't apply a skewed logic to what is written in black and white... it doesn't work in the real world.

You're right-stealing is WRONG! So why doesn't the FBI go after the REAL thieves-THE BANKS? You know them-the ones that take billions of OUR money, squander it, get a govt. handout, increase our fees through the roof-and then LAUGH AT US while cashing their huge bonus checks! Or how come they haven't gone after Verizon Wireless for stealing MILLIONS of dollars from the consumer every day by billing them all $1.99 in fees each month that they claim don't exist?
Even better, why not go after the cablecos for misleading advertisng? They seem to always promise six month promotions that end after three, 12 month ones that end after six, etc.
It seems to me that if Time Warner is doing well enough to buy Turner and Comcast is doing well enough to buy NBC, then why is the FBI wasting their time harassing the little guy when the BIG guys can get away scott free all the time-I'll tell you the answer-THEY ARE LAZY!! It's much easier to go read Craigslist, make a couple of buys there and bust a small fish-all the while trumpeting how GREAT a job you are doing protecting us from the awful cable thieves that are hell bent on ruining our way of life!!
Oh one more thing-bandwidth can NOT be conserved! ANY bandwidth NOT USED is WASTED-so technically you aren't losing anything!

There are plenty of people going to jail for things that were done wrong with our economy... but, there are also MANY factors that made up the economical crisis.. and to be honest, the consumer did much of it themselves willingly.. so, since I personally don't use credit, except to buy my house, maybe, since I'm paying more for the hands of irresponsible people turning their houses into ATM machines to buy a load of crap they couldn't afford, skipped out on bills and kept the loot.. maybe I should see about THOSE people being arrested too.. I mean, it's a crime to me!! I didn't cause this economic crises.. I didn't even participate in it for one red cent.. nor did my signature go on ANY paperwork to receive money from these corrupt deals that TWO Parties participated in.. *I* have been harmed there bud...
more than just banks too their part in bringing this economy down.. and, those that are being identified are in fact paying the price. Besides, in the pursuit of a global economy that so many people want, what many people forget is that some of what happened here in this country also took place OUTSIDE our shores... welcome to a global economy!!!! Enjoy it!!
As for the rest.. can't say much to it.. I mean, businesses are gone after all the time for advertising.. do you not see that? and I see you singled out cable.. how about phone who is the KING of misleading advertising, small print, contracts, and the inventor of ETF fees that seem to be front page news a lot these days.
When you don't post bias, rather, you speak more to the real issues, you may get more credibility.. you are FAR more over simplifying things and trying to justify one behavior over others "first"... again.. tit for tat doesn't work.
