yes. this is true. however, the docsis 2.0 spec gives you a raw speed of *almost* 43/31, which, when you subtract signalling, overhead, etc gives you a usable data rate of 38/27 *per carrier deployed*. because of the density that cablevision has deployed their cmts units and their taps/peds, they have more downstreams/upstreams deployed than other msos (in terms of numbers, not channel occupancy - i'm almost sure that there are only a handful of frequencies being used, but when you deploy gear you can use the same carrier frequencies in different neighborhoods), they can offer a higher utilisation per carrier because that carrier may serve a smaller geographic neighbourhood.

bottom line - can it be done in docsis2, yes. however, with channel bonding and such, its much more efficient to use docsis3 to offer higher speeds.
