This is just yet another attempt to extort money out of a generally unaware public. This kind of 'process' needs to be made illegal or, at the very least, HEAVILY regulated like bill collectors and the like.

I find this disturbing, but will make a great defense.
1. They are admitting the actual damages caused are 5-10% of what the industry claims. A $10,000 settlement is for damage caused, yet only $500 will "recover the losses". Thank you, the jury will like this.
2. RICO, anyone? Is there ANY Attorney General out there at least willing to investigate RICO on this? I'm not saying they're guilty, I'm saying society should make sure they're innocent. "Class action" wasn't built to work in reverse. Bulk Lawsuits won't help the USPS delivery mail on Saturday either.
3. DMCA needs amended, we need clearer definitions on "infringement" and certainly need a better litmus test to make sure evidence is solid enough before dragging citizens into a monetary "my lawyer's wallet is bigger than yours" battle... because that is what this is hinging on. It's in writing, from the plaintiff....
I do not condone "piracy", nor do I think it should go unpunished. This isn't the solution, however. Courts are meant to be equal, forcing the defendant into bankruptcy before the judge issues a jury as part of a preconceived marathon campaign by the plaintiff is a broken system.... fix it! | |
