In the case of broadband, it's he who has the gold uses public spaces (rights of way and airwaves).

I think this leads to the logical question of whether they who's public resources are used for business purposes are making sufficient rules concerning that usage. (I.e., classifying users as public utilities, setting rate increases, etc.).
