Quebec's Court of Appeal has paved the way for people living in common-law relationships to collect alimony after a breakup.

On Wednesday, he court overturned a lower-court decision that said a billionaire Quebecer didn't have to pay alimony to his common-law wife and mother of his three children.

While the woman at the centre of the case is unusual - she is seeking a $50-million lump-sum payment plus $56,000 a month - a change to the law would affect thousands of people who split after living together, then find themselves destitute.

All provinces and territories except Quebec have provisions for alimony to common-law couples who break up. In Quebec, a spouse is obliged to pay only child support if they live common-law. If they are married, all assets are split 50-50 when there's a breakup.

Goldwater's client, who can be referred to only as Lola, met the man in Brazil when she was 17. She came to Canada, wanting to get married, but the man insisted there was no legal difference between marriage and common-law - a misconception held by many, Goldwater says.

After seven years, the couple split. The man pays close to $35,000 a month in child support, covers school fees and provides two nannies and a cook. Lola lives in a $2.5-million home in Outremont.

After seven years, the couple split. The man pays close to:
-$35,000 a month in child support,
-covers school fees
-provides two nannies
-a cook.
-bought her a $2.5-million home
-paid many of her other bills, which totaled more than $200,000 in 2008
-He also buys plane tickets for the children and nannies for two trips a year
-as well as a daily allowance of up to $1,000 for the holidays

She wants:
-a monthly payment of $56,000 for herself (not including the child support, just alimony)
-a share of the family estate
-a lump-sum payment of $50 million

Will she get it? Is it too much?
