WTF. if you're phone breaks you still don't have to worry about the $10. its called insurance or full payment. you only have that if you don't have a contract or sign up a new line.

You have to start paying the fee if you ESN swap, no matter how you acquire your replacement phone.

Not entirely true:

"The Premium Data Add-on charge does NOT apply to:

* S&R exchanges (warranty or insurance events)"

But any other ESN swap will incur the fee:

" * Existing smartphone customers will remain on their current rate plan, until they upgrade, perform an ESN swap or activate a new smartphone"

So break your phone under warranty or insurance no extra $10/mon, any other reason $10/mon fee.
