What is being implemented here is the 2010-255 decision. In essence, the CRTC is varrying the 802 decision to add a discount. 2010-255 had the 25% discount, 2010-802 removed the discount.

Other aspects of 255 and 802 stand. This is the 60gigs/$1.50-gig/$30 max rates (with the $1.00 after 300 gigs starting march 1, this was included as an official notification to ISPs in december).

Bell Canada polls your usage numbers from its BAS routers at 03:00 every day. So if you are to calculate your own usage to compare, you need your cutoff to be at 03:00 on the 1st of every month.

Bell's 7293 tariffs (with the different rates for nontario and qwobec are not in force, the CRTC has not made a decision on those yet).

Also I fail to see how applying a discount from the retail offering of ILEC can be reconciliated with this paragraph, in the same decision :

The Commission notes that carriers’ retail UBB rates are market-based and are not subject to prior Commission approval – that is, they are forborne from regulation. The Commission also notes that the flat-rate component of the carriers’ retail Internet service rates recovers most, if not all, of the associated retail UBB costs. In the Commission’s view, this situation provides carriers with the flexibility to adjust or waive retail UBB rates on a promotional basis.

For me it means that they cannot regulate the retail offerings of ILEC, but at the same time they are forcing all wholeesalers to use those rate as a base for their own retail offerings, which is regulating retail rates...

Personally im not optimistic for 803 with this decision.

The more flaws there are in a decision, the greater the odds of a greater power up there overturning them. Remember that CNOC is expected to fiel a petition to Governor in Council tomorrow.

It is logically inconsistent, and possibly basis for an appeal.

Seems like it. So legally in Quebec they must do it withing 6 days to respect the 30 days legal limit on service change notification...

This is the Grand Canyon of loopholes in favor of the ILEC. Anything flagged as promotional can be done, including waiving all UBB charges, introducing "promotional" 1$ / 200 GB of usage insurance fees...

This is probably another base for an appeal. So if an appeal is done, this decision is a gold mine of inconsistencies and contradictions.

So i'll agree it's a good decision just for that

Well, this is definitely a win. Not as big of a win as many here would have liked, but still a win. It rolls back some of the changes made since 2010-255, and show some signs of awareness on the part of the CRTC.

The only thing this decision does for that is invalidate the currently pending speed matching tariffs.
