Yes, and no. There's examples: A law allowing a new network provider to access poles, for example, for a "fair" rate. Well, that's where the problems start.

I've heard of examples like this: "Sure, you can attack your cable to our poles--- but we're required to have XX amount of clearance from our lines to new cables, which are required to be xx amount of clearance above ground. So, no problem. You want to attach to the pole, we'll do it. Yes sir. But you'll have to pay us to move all our lines higher up the pole, and/or/install new poles. On your dime. Sure, we're up for it. That'll be $28,000 for each and every pole, please....."

So, yeah. "access required" and actual access are two different things entirely.
