Michael S.: Right now I can save you $99 by waiving the fee for equipment and activation. You then get the first 3 months of your contract for only $14.95 per month. and the remaining months are just $39.95 per month.

Michael S.: We lease out the phone line from your phone company to provide you the High speed DSL
XXXXXX: So Earthlink will also be limiting its Bandwidth as well

Michael S.: With Earthlink DSL there is no limites to usage.
XXXXXX: If you lease the line then most likely you will follow the terms ATT has, we are high users and require high bandwidth with the service provided. Based on Earthlinks past history, they follow the same lease line terms as the Global Provider

XXXXXX: Unless you can Guaranteed that earthlink will not limit the bandwidth for 12 month (terms by earthlink) should they limit, I will be able to terminate the contract without default fees within the 12 months and I need this in writting.

XXXXXX: Not good you can not Guaranteed that there will not be a bandwidth limit, but you can Guaranteed me that if I terminate the contract there will be a penalty based on the current terms. I'd say I would have to stay with my provider at this point

Live Sales Chat is not really a reliable place to get Policy and/or Terms information. A wild guess is the best you will get that way.
Plus you are incorrect about a major fact as AT&T is but only one of four providers of DSL that Earthlink actually resells. There is Covad (that's what I have with Earthlink) and there is Verizon, and there is Qwest and they don't have caps on their DSL like AT&T. Earthlink doesn't have to follow the same practices that AT&T sets.

Yeah I switched from ATT to Earthlink before the caps went in place. I asked MULTIPLE times with the sales reps and support from Earthlink if they would also add the caps. They told me no they would not be.
I never agreed to a 12 month plan with them as I had my 2wire modem from ATT and didn't need one from them.
My biggest hassle with Earthlink was getting them to mail me a bill and not do auto pay...
They kept trying to say they didn't allow paper billing ect. They finally told me I would have to sign up then once my service was switched from ATT to them I'd be able to call in and have it taken off paper billing.
I did this and when I called they tried to tell me I couldn't so I argued for awhile and finally got them to switch me to paper billing + a $2 fee on my bill each month for the printing of the bill and mailing it to me....
Long story short I think they or ATT are starting to throttle me cause lately my bandwidth goes to crap even with just downloading 1 file... |

AT&T cannot alter speeds on Earthlink customers without a request from Earthlink and only if they are the actual DSL provider behind the scenes...

EarthLink started me on DSL with provisioning by Covad a few years ago, but I was surprised to learn that I'm now provisioned by my CLEC, Verizon. The change was made silently, without notifying users, as far as I know. |

That is called a migration and they move blocks of subscribers back and/or forth depending on per line costs.
