New California laws for 2012

Because the State has evidently solved all of it's "more pressing" concerns, there are some new laws of note that will be going into effect in 2012:

1.) Probably the most important, but yet to be determined is the online sales tax. eTailers must begin collecting CA sales tax come Sep 1...unless online retailers can get Congress to adopt a nationwide standard for online taxes.

2.) No tanning at tanning salons for anyone under 18.

3.) Employers will be be barred from using consumer credit information about most job applicants or existing workers.

4.) Businesses will be fined up to $25,000 per incident for misclassifying regular employees as “independent contractors”.

5.) Businesses can not be compelled to use E-Verify, a federal program that electronically checks employees' immigration status.

6.) Courts can revoke for up to 10 years the driver’s license of any person convicted of three or more DUI offenses.

7.) Children must remain in booster seats until they reach age 8 or four feet nine inches tall.

8.) Cyber bullying; classifies certain posts on social networking sites as a form of bullying, incorporating them into existing law that deems cyber bullying as grounds for student suspension or expulsion. (Only applies to students in CA public schools)

9.) Offer a one-time traffic ticket amnesty period starting Jan. 1, that allows a lump sum payment of half the outstanding balance on certain traffic tickets (Moving violations). Only tickets due to be paid before Jan. 1, 2009, are eligible. Parking tickets, driving under the influence (DUI), and reckless driving cases are not.

10.) Allow students who entered the country illegally to receive private financial aid at public colleges.

11.) CA now prohibits carrying a handgun in plain sight.

12.) Ban on the possession, sale, trade or distribution of shark fins.

13.) Adds lesbian, gay, bisexual and transgender Americans, persons with disabilities, and others to the list of cultural groups whose roles and contributions to the development of the United States should be accurately portrayed in social science instructional materials in CA public schools.

It's interesting. The new contract I signed to extend my stay at my current job, classifies me as an Independent Technician.

I am W2'd by the agency, and they pay me bi-weekly via direct-deposit for hours worked at the client site. No O/T; straight time no matter how many hours I work.

I sit onsite at the client, use the clients equipment and take direction on daily activities from the client.

What a world of difference one word can make, eh?

My neighbor's kids (and their mom) will be in booster seats for life. By age 8, my boys were tall enough that we had to drive with the sunroof open.

Edited to add:

State legislatures passed close to 40,000 new laws in 2011, and a number of those measures take effect on Jan. 1. On some issues, like immigration, state laws are taking markedly different stands.

I don't know which is more scary - a do-nothing legislature or a prolific one.

OK, that's a lie. I know damned well which scares me more. 40,000 laws in 50 states. That's just wrong.

I believe the proper CA Dept of Labor term would be "exempt employee" meaning you are exempt from overtime and certain other hourly rules. Since the agency is sending a W2 they consider you an [exempt] employee, not an independent contractor, otherwise they would have sent a 1099. One of the categories of employees that can be considered exempt are those which are highly compensated, but it's been awhile since I did IT work in HR so I don't remember how much $$/hr it takes to cross that line.

The labor rules in CA are like a mobius loop twisted into a pretzel... for example; a few years ago I worked IT in a business that uses truck drivers for a main part of their business. It became common in that industry, as a cost saving measure, to layoff all their hourly employee drivers, and rehire them as independent contractors with a written contract. If they used company trucks those costs were deducted from their "pay" by leasing them the truck + charging insurance, otherwise they used their own. Apparently that was legit with the labor dept.
