You are absolutely right my friend. This is why we need to complain endlessly to Rogers. We need to start FaceBook/Twitter campaigns. We need to complain to anybody and everybody who will listen. We need to let the world know about Rogers unethical business practices.
I complained to the CRTC. This was their reply April 20 2012:

For Rogers to deliver the Rogers HiSpeed Internet "Express" tier to Docsis 2 modem users at the speed and data cap as currently advertised to the best of Rogers ability. It is our assessment that the subject-matter of your complaint relates to general operating practice(s). Further to Section 4.3 of our Procedural Code, CCTS is not able to issue Recommendations and Decisions that directs or requires a service provider to change their operating practices and policies.
