Does your contract actually say you will use your own gear, or that you will use comcast's gear? If it's in your contract that you're using your own gear, you should be able to get the fee removed. Otherwise, nope. Even if you are permitted to use your own, your service is billed as if you are not (if that's how the contract is written.)

I waited a long time for Comcast phone support to resolve my problem. Then yesterday put a post on Comcast Direct. The problem is resolved as of this morning. Less than 24 hours after posting on Comcast Direct here in dslreports.com. There is no modem bill for me, and credits for the 2 months they did bill me for a cable modem have been applied to my account.
