Received Two Notices from Comcast - Now What?

Over the past week I have received two email notifications from Comcast regarding "Notice of Claim of Copyright Infringement", both for adult movies. After I received the first notification I immediately took steps to "clean things up", so to speak, but unfortunately between the time the first "incident" occurred and when I was notified of it, the second "incident" occurred. My stomach has been in knots since I received the first notification. Lesson certainly learned but now I am wondering what will likely happen next. I have been looking up information since I got the first message, both here and elsewhere, and have seen everything from basically "laugh it off" to "you're in trouble", with lots of stuff in between. So, now I am looking for some info / advice of people who have actually seen these things.

Here are my questions:

1. I see a lot of people mention letters as opposed to email. Has Comcast switched to email notification or is it likely that I will receive something in the mail as well?

2. What are the chances that my Comcast account will be suspended or terminated? I figured I would be OK with just the 1st notice, but now I'm worried about getting a 2nd one so soon. I do not believe the actual amount of data involved is that much, if that matters at all.

3. Is it possible that anyone will use these incidents to look at past history?

4. What are the chances that a "John Doe" lawsuit will result from these incidents? I have read some info that indicates that the adult entertainment industry seems to push these things more than others.

5. If a lawsuit does result how long would it likely be before I am notified of it? How would I be notified of such a lawsuit? Would something come from Comcast or directly from 3rd part?

At this point I think I do not plan on responding to the email from Comcast in any way. I am now sitting back and hoping for the best, but kind of expecting the worst. Any help or info that anyone could provide would be greatly appreciated.

Dont worry about it Ive heard of people getting up to 6 notices but I would stop now theyre obviously specificallly keeping an eye on you now "I've heard" dont hold me to my word but a comcast tech said that its harder track people during the day when everyones on as opposed to late whenever no ones on. I personally received 2 i stopped though I suggest stop atleast for awhile anyway..

O and dont respond to the email if anything was that important they would mail it to you, and if you were getting sued you would get certified mail that you would have to sign for theyre just giving you warnings dont sweat it too much

direct download, or torrents?

torrents- stop sharing....

direct download- use better sources...granted this is coming to end with the loss of sharing upload links on filesonic, etc.....

be more careful.....

It's important that you take these notices seriously - which appears you have.

While the company who owns the copyrighted material could go after you for damages, it's very unlikely. You're just a fish in a really big pond, and there's larger fish they are interested in.

It's possible you may get additional notices, if you continued to download copyrighted material.

Do not respond to these e-mails, just save them for your file.

On a related note: With the amount of free material available online, there's no need to download adult movies.

Learn from this, and move on. Don't let the events cause you additional stress or anxiety, it's unneeded. You'll be fine.

Thanks to those who've replied; you have definitely put my mind at ease, at least somewhat. These were torrent downloads, btw, for the person who asked. As I said, lesson learned. I certainly will not be downloading anything that I think / know is copyrighted material for a very long time. I was stupid and/or naive. I always thought there was a "gray area" with regards to torrent downloading, but I never knew anything about these "John Doe" lawsuits until I got the first warning and starting doing some research. It's just not worth even taking a risk of being involved with something like this.

This is the new approach...

You'll get several warnings before something more serious happens.

Ideally, after a few warnings, you'll stop doing whatever you're doing that's generating the letters, and this will all be but an interesting story to tell your grandkids someday.

This is the reason I will not download copyrighted material unless I pay for it (such as iTunes or Rhapsody for Music or Netflix for Movies) or get it from another lawful source such as the Springfield City Library (requires library card #) website. I am careful of what I watch on YouTube because some of the videos are pirated but YouTube is very good about purging their site of copyrighted material. Many times YouTube videos will have their audio track disabled because it contained a copyrighted song.

If I were you, I'd stop downloading the copyrighted material because copyright infringement is not only a civil matter but a criminal matter as well. If you read the FBI warnings at the beginning of a DVD, criminal copyright infringement is a federal offense that is punishable by up to 5 years in federal prison, up to $250,000 in fines or both.

All of my CPE (including my EMTA) is customer owned. The only Comcast owned equipment in my house is the CableCards in the two TiVO boxes I own.

In neither case was I seeing the file after downloading, if that's what you mean. I have a couple of theories about what happened. It might be a combination of both, or I could be way off.

First, within my bittorrent client I typically have some Linux ISO's, which I know are legal, and some live music shows downloaded from dimedozen.org, which I'm pretty sure are legal (although after this issue I am going to check and double-check this), active and seeding. However, at the beginning of the year I cleaned things up and had a lot less torrents active than normal. I think this may have freed up my upload bandwidth so that while I was downloading these files they were also uploading at a faster speed than normal. I know, for example, for the 2nd file that when the download, which was around 250 MB, was done my bt client showed that around 320 MB had been uploaded.

Second, both of these torrents were poorly seeded when I downloaded them, so I left my bt client running longer than I typically would have to. Again, this allowed more info to be uploaded than normal. I think in the 1st case I had the client running for around an hour. In the 2nd case it was a little longer, but it wasn't like it was active for several hours.

He didn't ask for advice on how to get away with it. Can't someone just admit that what they did is wrong and accept the consequences? Oh, and the next time you hold up a 7-11, be sure to wear a ski mask.

I never said the notifications were for the Linux ISO's and legal files, and I never said the files I was flagged for were "legal". I *do* download Linux ISO's and music files from dimedozen.org. This is how I first became familiar with BitTorrent.

He didn't ask for advice on how to get away with it. Can't someone just admit that what they did is wrong and accept the consequences?

That's right, I'm not asking for advice on how to get away with it. What do you think the consequences for my infractions should be?
