I should note, if you live in an area with over-builders and FiOS, the caps appear not to be enforced.

Why should customers need to do that? Nothing changes except customers would get less bandwidth for their money, get stuck with a modem they don't want and they will lose their bundle deals. Users that have the Extreme tiers already pay a hefty premium.
