[Newsgroups] Giganews and it's DMCA Affirmation

I have received several Giganews DMCA infringement notices and as a result I have had my account put on hold. The annoying this is that I only download and the notices was for stuff that was uploaded/posted. In the notices it mentions the specific infraction or messages that were posted. They were of TV shows that were up loaded. Now I took a close look at those, they all seem to have been uploaded on the same date and by a specific IP. The ip shown was one that is in Germany.

Here's an example:

Now I live in Canada, so that worried me right away. I changed my username and password after realizing that. Did a full malware and antivirus scan of my computer to make sure it was clean.

After the first few notices I got some more but I'm noticing that they are from the same day and same IP. I don't know why they are being sent as separate infringements or seperate notices.

Also now if I want to re-enable my download and posting privileges I have to sign some DMCA Affirmation. I'm very wary about that. I'm not sure what it is I'm singing exactly? In case my account gets hacked am I opening myself up to fines and what not or are they just gone cancel or suspend my account? By signing that, as a Canadian citizen will I be subject to the laws of the DMCA?

Here is the DMCA Affirmation they want me to sign:

"I, **My Name Here**, have fully read and agree to Giganews' Terms of Service linked here »www.giganews.com/legal/tos_personal.html. I understand that Giganews only sells single-user accounts, and therefore all posts made by my account are my responsibility. My Giganews account will no longer be used to post any unauthorized copies of copyrighted materials. I understand that Giganews has the right, authority, and complete discretion to terminate my account without notice and without refund or suspend posting from my account should further unauthorized copies of copyrighted materials be posted. I understand that this is my first and last chance.

Under the laws of perjury in the United States, I hereby affirm the above and that my name is **My Name** and I reside at **My Home Address**. I further affirm that I electronically sign this form of my own free will."

You live in Canada, just sign up with a new provider. Giganews is expensive anyway.

I don't use their VPN service. It's cause my account was hacked and someone from Germany or using a German IP uploaded copyrigthed materials.

If you insist to stay with giganews and you don't care about posting, just tell them to go ahead and block your posting. That would solve the problem for good. You could also just cancel and make a new account and forget signing the notice.

Yes, my account was hacked and someone was posting stuff under my account.

I have heard of people getting these Copyright Infringement notices using their VyperVPN service on torrents but not this way.

Sorry to hear you got your account hacked. Giganews is way overpriced anyway so you won't lose much going to another provider.

As far as your security breach, even though you did a malware and antivirus check, there could still be something on your system maybe recording your activity still and that is how they got your account details. I would start from scratch with a format and reinstall of the OS, backing up any pertinent data to begin with of course. Run any suspicious programs in a sandbox and disable Internet access in those sandboxes. Sounds drastic, but someone got your user name and password from Giganews somehow and they probably didn't hack Giganews to get it.
