Re: [CA] *NOT ASKING HOW* Is it legal to uncap?

I really need to start recording my calls.

I could post a recording of the rep saying "Yes that is the 15 megabit speed"

And then me agreeing to the contract.

If the bank said i had $1500 in the bank by error and i withdrew $1500 would that be illegal?

You're example does NOT fit.

Actually yes, if you withdrew the money even if it was a bank error you would be charged with theft if you did not return it upon request.

Ummmmm YES!, it is still not your money and they have a right to get it back from you.

My example does fit. Uncapping your modem is like breaking down the door to the vault by force and taking what you want.

Do you have any sources?

I never realized there were people who actually thought this way.

No sources needed, it is just common sense. If you take something that is not yours it is wrong.

What about over clocking your processor?

Unlocking Cores?

Hacking the ECU on your car to get the same amount of horsepower as the GT model you normally have to pay extra for?

Jailbreaking an iPhone (recently exempt from DMCA)

Getting free refills at restaurants?!?!?

I fail to see how any of those apply to uncapping your modem. All of these (aside from free refills) are modifications to a device that you wholly own. Uncapping your cable modem while may be technically legal, is illegal once you begin to receive bandwidth in excess of what you are allowed by your ISP.

Now, Free refills would depend on if the restaurant offered free refills or not.

If they did not offer free refills and they "Capped" the amount of pop you could receive unless you paid for more, would it be legal to go around the counter and pour yourself extra because you feel that you should be getting more?
