It may not be Canada Post. Think about it... The gym gets a registered letter, what do you think they think it is? They *KNOW* it's a cancellation, since who else would send registered mail? What they might do is have reception say that 'no one is available to sign for it'. Then the letter carrier leaves a notice with reception and sends the letter to await pickup at the local postal outlet. Then the gym 'forgets' to pick it up, which means you get it back 15+ days later after the waiting period expires.

Based on how sleazy many gyms are, this may be a delay tactic.

Our place ships worldwide via Canada Post. Yes, we also love their new pickup service.

I am not sure how their customer service is for regular people, but for business accounts, if there are problems for us we get phone calls from CS offering to investigate stuff, & whatever.

Fantastic pricing for domestic & international shipping, easy integration with websites for Ecommerce operations in Canada, & great customer Service.

I may have mentioned this in another Canada Post thread, but at one point the Gateway facility in Mississauga was designed and built to streamline mail deliver in the GTA.

I knew someone that used to work there and this was how the properly vetted and supervised union employees handled "streamlining" delivery.

M-Th. Mail bags diverted and hidden in various locations around the facility. Friday. Mail suddenly "discovered". Whoah! look at all this mail! No way we'll get it all sorted today! Guess we better come in tomorrow and work some over-time! And some wondered why sometimes it took 48 hours for a letter to get from Oakville to Toronto, and sometimes over a week.

I'm sure crap like that still goes on.

To show you how convoluted this is.

The mail would have been picked up at the postal outlet and taken down to Eastern Avenue sorting plant.

It would have been sorted then sent to the postal station at Kennedy and Ellington.

It would have been further sorted overnight by walk, then the carrier would sort it by his or her route.

Not bad for less then 24hrs.

The reason the USPS is looking for bailouts is due to Congress requiring the post office to pre-fund its retirement for 75 years..
The USPS is not [generally] taxpayer supported.. except for some loans recently. [The yearly payments are about $5.5 billion.]

You need to print the tracking with some sort of time stamp on when you have extracted a copy.

Remember that the tracking info can change. By the time you would get to small claims court, you may have tracking that shows the document was delivered on time.

I printed a PDF of the webpage, which includes a time and date stamp.

So I called to lodge a complaint, they go "Sometimes it doesn't update the tracking" Then why give me a F'n tracking number in the first place?

"Did you call them to ask if they got the letter?" I'm trying to cancel a contract, what do you think they'd say?

I've had this happen to me for an inbound package. Tracking showed that it was on it way from the processing centre to the local post office, and 3 day later, it still hadn't gotten to the post office.

This was to a PO box. What happened is that the post office got the package and processed it, put the little notice in my box, but forgot to scan the package, so the CP system still thought it was in the truck.

However, in your case, since this was a "signature required" item, they would have had to have the delivery guy enter a tracking event in the system.

You need to get CP to start an investigation and mention that you may be liable to contract cancellation penalties if the GYM didn't get the letter and that you really need to know when they got the letter.

Canada Post will want to know if one of their employees slacked off. For premium delivery service, CP really wants to get the stuff there.

Can you confirm this was expresspost ? Priority Post ? Or just first class mail ?

WOW.

If the customer service reps are stonewalling you (They're union workers too) then your best bet is to contact the Canada Post Ombudsman's Office. These guys actually get results. No bullshit. Just results.

If you want a straight answer about what happened to your letter with no crap from the disgruntled union CSRs this is the next phone call you should make.

I don't have any advice other than what's been already given, but this happens to me all the time when I use non-guaranteed services, where I can't get my money back if it's late.

With the guaranteed ones, the tracking updates properly 99.99% of the time.

The delivery receipt is available on-ine at least 24 hours after receipt.

And because it is sent as regular mail, if it is sent to a PO box or other group mailbox, they drop a card teling the recipient there is registered mail waiting for them. Signature/delivery not done until they go to the post office to pick it up.

This is very different from expresspost which isn't more expensive but which is fully trackable and uses a "courier" style of delivery istead of the regular post man.

However, you should have received a proof of sending with a date on it, and you can use this if you have problems with the GYM.

It's literally around the corner from my house, I could walk there faster then CP can deliver it.

A week later, it's "Still out for delivery" man are they incompetent.

Monday is 3 weeks and it's still out for Delivery.

I called them and they are "investigating".

Lugnut I can't involve the Ombudsman till I get back a "Final answer".

I am guessing that you live in Ottawa (Harperland) but the following are excerpts from the Ontario Consumer Protection Act.

Delivery of notice

(5) Notice may be delivered by any means. 2002, c. 30, Sched. A, s. 18 (5).

When notice given

(6) If notice is delivered other than by personal service, the notice shall be deemed to have been given when sent.

AND most important, the following means that you did not sign away your rights to give personal written notice terminating the contract:

No waiver of substantive and procedural rights

7. (1) The substantive and procedural rights given under this Act apply despite any agreement or waiver to the contrary.

That sound you hear is "the point" flying so far over your head it isn't funny.

Is your gym a federally legislated company and/or Crown corporation? I'm going to guess not. Which means you don't need to send a registered letter, you can hand deliver it if you want to, irrespective of your contract.
