The function of the commercial is to attempt to deliver it to eyeballs NOT to force the eyeballs to see it. It is the supposed function of ratings to count the eyeballs that POTENTIALLY have a chance to view the commercial. There is nothing in the payment that says the commercial has actually be seen by the viewer.
This is not really an argument of the legality, it is about the ecosystem. Charlie wants to rape the rainforest and not expect floods and runaway climate change. True to form, he is greedy.
