I can see where they're coming from.
While I'm not sure I'm seeing the entire picture being mentioned in this story, if the FCC allowed for the tests to be ran on the ISP local network but also, the FCC continued to run their own tests as they are currently by making the data transverse the Internet, it may help clue into where additional problems may be, such as in the last mile or in the backbone.
But, the FCC needs to remain transparent with their data. They need to stick to using the MLab Platform and simply allow ISPs to place servers on their network for the direct comparison between last mile performance and last mile + backbone performance. Otherwise, no deal and any efforts such as Sam Knows would be pointless.
