No 15 minute breaks?I just got a new job. They give you 1 hr lunch break, but no two fifteen minute breaks. Is this legal? |

Yes last I read according to Federal Law. No in some states, others it is perfectly legal. |

I have never, ever had a job where you were given 15-minute breaks plus lunch breaks. I have never, ever had a job that gave you one hour lunch breaks (though taking such breaks meant I was expected to work later in the day).
Besides my web dev company, I also own restaurants. I don't handle that day-to-day operation anymore but the employees there get breaks, however, I don't think they're legal requirements. When I ran that operation, you ate on the run and were given no breaks. (We ran with a light crew so everyone could get 40 hours.)
If the laws have changed, I'm not aware of it. Probably other states have their own laws but 15-minute break requirements? Never heard of it. |

You should see my job have a 4 hour shift and you only get a 10 min break.. So by the time I go to the bathroom wash my hands and get something from the food truck I've got about 4 min left to down a hot meal.. |

Who in the world gets a full hour lunch anymore? All the jobs I had (and family and friends) get a half hour lunch and the 2 breaks which add up to 1 hour off just spread out, I would rather have the full hour with no breaks myself! |

With many companies (no need for comments about an employer who gave no breaks, etc, etc), either a 1-hour lunch OR a 30-minute lunch + (2) 15-minute breaks is fairly normal.
Different places base it on the type of work, i.e. assembly-line, continuous work or manual labor vs a desk-type job (where the person doesn't have as strict of a schedule and can step away without any problems). |

When I worked at Sears a few years ago I got a 30 minute lunch break if I worked atleast 5.5 hours(includes 30 min break) and on an 8.5 hour shift(including 30 minute break) I was given a 30 minute break and two 15 minute breaks. I was lucky and had a very lax manager who was also a chain smoker so he didn't care if we were slow and you were outside talking with the other smokers(I don't smoke) or in the break room for 5 minutes here or there to rest your feet. However, after the first few months I stopped taking the 15 min breaks as there was never enough people to cover.
Now that I work in an office at a desk job, I get an hour lunch if I want and work 8-5 or a 30 minute lunch and work til 4:30. I usually take the latter; I don't want to stay longer than I need. |

I worked at a gas station for 6 years and ran the 2nd shift by myself with nobody else there, I did not get breaks. but when I moved to meijer and there station I got a 30 minute break and 2 15 mintue breaks if I worked 8 hours. |

depends upon your state, number of hours worked and FSLA status non-exempt(hourly/overtime eligible) or exempt
EDIT: if i recall correctly- in my state for non-exempt you get at least 10min paid break every 4hrs worked (many places give 15), a 30min unpaid meal break if you work over 6, but it has to be started and finished in the first 5hrs, and over 10hrs you are eligible for a second unpaid meal break but it can be waived if you choose and have said so in writing to the company. also you cannot combine the breaks and meal periods unless the work demands it and other legal bs....
for exempt you better not be taking ANY breaks unless everything is smooth sailing.... then go ahead and take an hour or two-- hell just go home early |

I'm in OH. 40 years ago, I had a gas station job with no break periods whatsoever. When that job ended, I worked as a dispatcher in a forklift service department. I had a 30 min lunch break (but I still had to answer the phone if it rang) and no 15 min breaks. Now I have another desk job with a 30 min lunch and 2 15 min breaks, but if the work backs up as it sometimes does when they dump too much on us all at once, they will take away one 15 min break whenever it suits them...sometimes for weeks at a time. I have no idea if it's legal but I'd sure like to know. |

We have 2 - 15 minute breaks and choice of either a 30 min or 1 hr lunch. Of course if you take the hour lunch you have to work an extra 30 minutes. |

Labor laws vary by state. But yes, it can be perfectly legal.
Here in Illinois the law provides for a single break of at least 20 minutes for employees working longer than a 7.5 hour shift. The break must be given no later than the fifth hour of consecutive work.
Working less than 7.5 hours means no break is required. |

We can take lunch for any duration we want. We typically take a 30 minute lunch with out (2) 15 minute breaks for a 1 hour lunch. The entire department does that so we work from 7am-3:30pm with a 1 hour lunch.
All states have to give you enough time to use the bathroom as needed though they don't call that a break. |

I've worked in Arkansas for the last 9 years (the corp office is in California), and before that I worked in Los Angeles for years, and I can't remember NOT having a 1hr lunch and two 15min breaks. A lot depends on the employer. I've been fortunate that the company I'm with now and the prior one I worked at for 10yrs were both very employee friendly. |

Try working 10 hour days, plus getting calls and emails on your BB 24/7/365, only get paid for 8 hours, no 15 minute breaks ever, and lunch at your desk every single day. |

One of the places I work at: Salaried employee's: 2 15 minute breaks - paid, and a 1 hour lunch, unpaid. Hourly employee's - 2 15 minutes breaks - paid, 1 20 minute lunch - paid. This province I am in required employers to give a 10 minute break every 2 hours (if it exceeds 3 hours) -- however, it doesn't require the breaks to be paid. Most people don't realize that their "paid" breaks aren't a requirement. |

When I worked for IBM I could take my (2) 15 minute breaks together as my lunch so it was 8 am - 4 pm every day with a 30 minute lunch. My new company makes us take an hour but my boss let's us use our (2) 15 minute breaks as half that time. All I need is 30 minutes for lunch. |

Glad I'm not the only one that picked up on that I was always exempt (salaried) so I had the privilege of never taking a break. Honestly, I usually took less than the non-exempt. Ate at my desk half the time while working. In 40+ years I don't remember of ever working at a company that didn't give breaks. The only time there might be a problem was if there was a line running that couldn't be shut down. |
