There was a trial at which he testified. The defense attorneys didn't tear any holes in his story, and they're more adept at this than you and I are. So he was acquitted of that charge. McQueary's testimony wasn't found inconsistent in court. It just didn't provide enough evidence for the jury to convict on the rape charge. The jury specifically asked to hear his testimony re-read to them while deliberating, and that resulted in 3 convictions of Sandusky and 1 acquittal. Not seeing the penis enter the rectum was why he was acquitted on that one.<br><br>I really don't know why that's so hard to understand. There's been an attempt all through the Sandusky investigation and prosecution to villianize McQueary. Initially it was because he reported things to Paterno, and Paterno fans didn't like that and went after McQueary. I understand that -- McQueary's testimony to the GJ exposed a hero's involvement in not reporting things to police that turned out to be crimes. But the grand jury's over. The trial's over. The NCAA sanctions are over. There is no failure on the part of the Penn State administration or athletic department for the handling/mishandling of anything that occurred w/r/t this incident.  If anyone failed, it was the DA, CYS and DPW. They were on the case. <br><br>Fact:  McQueary stated that he never used the words anal rape when he described Shower 2001. The Grand Jury report that incited the mass hysteria put those words in his mouth in their presentment.  He denied ever using those words.  The jury did not convict Sandusky of that specific charge either.  Furthermore, you do realize that the GJ presentment also stated as a 'matter of fact' that the McQueary shower incident was March 2002.  It has been shown that the GJ report is, in fact, incorrect.  The incident occurred in February 2001.  Sandusky of all people had the year correct; not the Grand Jury.  <br><br>It remains to be seen if the gentleman that came forward is victim #2 or not.  Perhaps when he is released from prison the world will find out. ]]></description>

There are a couple high profile stories that you can read about, but one I watched on 60 minutes was re-aired about a couple weeks ago.  Michael Morton was convicted but his conviction was overturned due to DNA evidence. <description><![CDATA[Edge1 posted : As a PSU fan I can say that I've moved on from them and that they are, in fact, irrelevant.  Much like our football team will be for quite a while, but I'm pretty  much OK with that after this whole nightmare.  I just want college football on Saturdays and it will be nice to know that our program, while probably non-competitive, will be clean.]]></description>

Are you ok with this level of punishment?<br> </p></div>You hypothetical is apples and oranges to the Penn State mess. I understand the point you are making. There are worse real life examples of injustices done to innocent people. Take Enron, for example. A handful of corrupt people cost hundreds of employees their jobs and millions of dollars. Those displaced people moved on with their lives. That is what happens in the business jungle. Big time college football has become a business jungle too. The 'ol college try' has been long gone. The bigger they are the harder they will fall. The Penn State people will move on. There was absolutely no way that innocent people were not going to be affected by the punishment dished out to the football program. We are arguing at the margin. I would have been ok with a harsher punishment too, like the death penalty. <br> </p></div>Fair enough explanation.  I am glad you see the point I am making. And like I said in a post above, I think the NCAA are supreme hypocrites in how they have acted in the past concerning the domination of major universities by their athletic depts and how they dealt with those situations.<br><br>But maybe the lesson they are really trying to teach with such drastic penalties is to the University Trustees and the alumni groups who have long made possible the domination and abuse of university administrations by athletic departments. Alumni groups at universities with major sports pgms(both football & basketball) constantly threaten the Trustees with pulling their financial support when the Trustees don't rollover and play dead and kowtow to every demand by the Athletic Dept. I don't let the Trustees off the hook here for being such cowards, but ultimately the Alumni groups at schools like Penn State, Notre Dame, Alabama, Miami, Mississippi, Texas, etc exercise undue influence in supporting Athletic Depts, often at the expense of the university as a whole.<br> </p></div>I can agree with your analysis.  I don't approve of some of the punishments, and probably never will.  Still, you are right that the $60 million and loss of bowl games would have been strict enough. College sports is too big, too big of a business, young athletes are used for the enrichment of the institution...sure they get their education paid for but they bring in so much for the institution. Or when SMU was found guilty of giving half the roster of student athletes improper benefits and they were sacked for 4 years.<br><br>Then, in a case like this, when 5 people knew what was going on, 4 of which were in the wrong, the NCAA drops the ball.  Punish the university, but keep the student athletes out of it.  The right call would have been to fine the university 60 million, and then take ALL bowl game proceeds for 5-10 years which would have been a total of at least $200 million and give that to charity.  <br><br>Let the students play on.  Let the fans cheer.  Let Sandusky rot in prison.  Let the Paterno fans and family cry about losing 100+ wins and not getting the record.  That would have been doing this the right way.  As it turns out, they got it wrong in some aspects, and now the innocent are forced to be punished when they did nothing wrong.  That, IMO, is bullshit.<br> </p></div>No offense taken. <br>I will bet we all can agree that the NCAA is far, very far, from perfect. We all can debate forever why one issued penalty deserved a more severe penalty than another.<br>And I certainly don't know what football players you associate with but having played some ball I can say without exception that these are some resilient guys who can and do adjust. Who are these terribly hurt victims that you speak about?<br><br>Again, no matter what action was taken, there were going to be people who were treated unfairly. (e. g. is it fair that all the players on this year's Ohio State football team, none of whom participated in the tattoo scandal, will suffer for the actions of a couple of guys and the coach who was fired?).<br><br>A lot of these rulings simply boil down to the lessons taught. And the Penn State lesson certainly needed emphasis.<br><br><b>IMO nothing would change unless it was bulldozed into minds of those who worship at the altar of power or tradition or winning etc. that to be indifferent to the plight of "torture" to innocent children will not be permitted. You will not be allowed to cheat, ignore or just forget wrongs because the pawns in life have so little value while you and your inflated ego are safe because you have ascended to heights of power and position. I think we as a society have tacked up a small but convincing note that says no matter how high you rise, THIS at least, will not be tolerated!</b><br> </p></div>I think less of an emphasis needed to be put on Penn State as a whole.  As I said before, to which no one has been able to debate me on, this crime was perpetuated by 4 people.  Curly, Schultz, Paterno, and Sandusky.  These 4 people were the only ones with knowledge of the situation according to the Freeh report.  It was these 4 people that are going to be incarcerated or fired for good reason.  I would be inclined to agree with you if part of the team knew this was going on, but as it stands, that didn't happen.<br><br>So why teach a lesson to those who weren't responsible?  As I said before, is it right to punish the embezzlers of a company and then punish everyone working at the company by cutting their pay by 10% and taking away a week of vacation just because 4 people stole millions?<br><br>Yes, we can agree that the NCAA is very far from perfect.  I don't know any professional football players, but I do know a number of D1 hockey players since I used to write/photograph for an ESPN affiliate from 1998-2006.  They are tough guys as well and I am sure they will adjust.<br><br>So, why don't you tell me why Penn State, as a whole, needed emphasis on being taught a lesson in this specific case?
