| reply to Harddrive I'm surprised by a few things that Koh wouldn't allow in. But I don't know the circumstances behind her denial of that kind of evidence. On the face of it, though, I think it would certainly help Samsung in the appeal. The significant part of the decision was based on trade dress.  Wily_OnePremium join:2002-11-24 San Jose, CA | Yes there will be appeals as well as escalation of the thermonuclear patent war. While this suit was aimed at Samsung, this was really about Android. Google will have to step up to defend against and countersue Apple.
The trial they need to have is whether Apple's cache of patent-everything claims are in fact valid patents. That a patent was awarded is not enough, which is the heart of the patent brokenness in this country. |
