<description><![CDATA[Bob posted : I'm trying to remember how it worked when my wife totalled her Volvo.  I think the insurance company got a payoff quote from the finance company, and the insurance company paid-off the loan directly.  Then the finance company held on to the title for another 2 weeks (in case the insurance company check bounced!), then sent the title to the insurance company.<br><br>At that point, the insurance company would have mailed me the title, had me sign it over to them, mail it back, then the insurance company would have mailed the check to me.  I opted to go to the insurance company headquarters to sign over the title and get my check in 2 minutes instead of dealing with mailing delays.<br><br>Bottom line is all that stuff took forever, and I had to borrow money from a family member so I could get a new car without waiting for all of the above.<br><br>The insurance company payment was more than I expected.  They go by the retail book value.]]></description>

When the insurance makes their first offer, you counter with your offer. It is a bargaining arrangement but you have to prove the value for which you are asking. Do not accept an offer until you are happy. When I bargained with an insurance company it was down to arguing over $4.00. Just remember you do not have to accept the offer if you don't like it. Demand high value but be able to prove it.<br><br>You are entitled to the value of the vehicle, sales tax and depending on the state, vehicle registration fees. You generally up to 30 days of rental at $30.00 a day. The insurance company will issue the check payable to the loan company and you. You have to sign the check as does the loan company. Once you get your money from the loan company then the rental is finished. But don't be quick to let the insurance company know you have the check. Extend that rental for as long as necessary.<br><br>The car will be totaled of that I am fairly certain. The drive train and parts of the car that support the drive train have been distorted. The car will never drive correct again. Also if the battery was cracked the acid will damage the metal and that would also need to be factored into the cost of repairs.<br><br>No compensation for increase in interest rate. Compensation for tires is negotiable but don't expect much.]]></description>

If they total your car, the reimbursement will end when you get your check. That is adding in the total estimated cost of the Rental.  And to goose it along, would make a guess that there would be hidden damage discovered during repairs and additional rental.  <br><br>And the Claimant would get it out of the shop, drive for a week and discover additional damage via noise or whatever, adding more cost of repair and rental.  <br><br>Many newer, nicer cars, have pushed over the edge using the above techniques as an Adjuster.  Otherwise they became moneypits. <br><br>Edit: forgot a very important part of the equation - the value of the damaged vehicle as it sits or salvage value.  Many times that alone pushed a car into a totaled status.<br><br>Then there is the diminution of value aspect.  Though in my day rarely ran into that.<br><br>hth]]></description>
