I can understand the law in the case where the driver shares the vehicle with other employees but an Owner/Operator owns the vehicle and it is as much their personal vehicle as it is their work vehicle.

I am pretty sure it has happened. I am not sure there has been an outcome.

I believe it's a different case, since the charges were withdrawn Jan '09 in your link, but were laid in June '10 in mine...
