To clarify:

- DOCSIS 3 is available and covered under TPIA, and some wholesalers already offer it

- Any wholesale ISP not offering the full set of speed tiers is doing so for business reasons.

- As an example, Rogers' higher speeds require the new aggregated interconnection style, and an ISP that is using the old interconnection style would face significant costs and disruption to switch over.
